Art.1 General & Applicability
- All (letting) agreements / catering transactions between Parkstad Limburg Theatres (with the venues Theater Heerlen, Theater Kerkrade, Toon Hermans Theater Sittard) and the lessee are subject to these General Terms and Conditions of Letting. These General Terms and Conditions for Letting also apply to all actions carried out in execution of these (letting) agreements / catering transactions.
- For the purposes of these General Terms and Conditions of Hire, a hirer is any person or legal entity which in any way, directly or indirectly, concludes an agreement with Parkstad Limburg Theatres regarding the use of (operational) services to be provided by Parkstad Limburg Theatres, including hire. In addition, these General Terms and Conditions of Rentals are declared applicable to anyone directly or indirectly involved in the use of (operational) services to be provided by Parkstad Limburg Theatres, including rentals.
- Also applicable to all (letting) agreements/hospitality transactions between Parkstad Limburg Theatres and the lessee are the Uniform Catering Conditions. The UVH are filed with the Chamber of Commerce in Woerden and registered there under number 40482082. See the website of Koninklijke Horeca Nerderland/UVH. Parkstad Limburg Theatres declares the Uniform Hospitality Industry Conditions applicable to the (operational) services it provides, including rentals. In addition, these Uniform Conditions of the Hotel and Catering Industry are declared applicable to anyone directly or indirectly involved in the use of (operational) services to be provided by Parkstad Limburg Theatres, including rentals.
- In addition, the General Visitor Conditions of the Association of Theatres and Concert Halls (VSCD) apply to all (letting) agreements/hospitality transactions between Parkstad Limburg Theatres and the lessee. These General Visitor Conditions were filed with the Registry of the Amsterdam District Court on 27 September 2021 under number 50/2021 and published on the VSCD website (www.vscd.nl). Parkstad Limburg Theatres declares the General Visitor Conditions of the Association of Theatres and Concert Halls (VSCD) applicable to the (operational) services it provides, including rentals. In addition, these General Terms and Conditions for Visitors of the Association of Theatres and Concert Halls (VSCD) are declared applicable to anyone directly or indirectly involved in the use of (operational) services to be provided by Parkstad Limburg Theatres, including rentals.
- Local regulations, police ordinances and the operating licence granted form, in addition to the statutory regulations, the framework within which Parkstad Limburg Theatres operates.
Art. 2 Letting & rental rates
- The primary task/objective of Parkstad Limburg Theatres lies in a cultural and artistic content objective, which means, among other things, that it uses its buildings and resources above all for its own programming.
- If space is available outside this regular programming, it can be leased to third parties for various activities, which are (preferably) in line with the above-mentioned objective. The lessee declares to use the rented space(s) exclusively for the above-mentioned objective. The management team of Parkstad Limburg Theatres reserves the right to make substantive/financial checks on this.
- Parkstad Limburg Theatres distinguishes within the rental between mainly three forms of performing arts, namely:
- professional companies in the performing arts;
- amateur companies in the performing arts/social context (socio-cultural);
- commercial hirings (commercial);
- The rental period is calculated from the time of the start of construction up to and including the return of the stage and auditorium to standard (in accordance with Article 2, Paragraph 5 under a and b), as suggested at the start. Parkstad Limburg Theatres reserves the right to make other choices in this regard, including on the basis of the (regular) programming.
- Rental rates (room hire, resources and staff deployment) are set per season, reassessed/indexed annually (January of each calendar year) and are broken down per type of room/per location:
- Rental rate per half-day period with a minimum of 4.5 hours (full rate). Additional hours are charged per hour at a reduced rate of a percentage to be determined, which may/will differ per location;
- Rental rate per half day with a minimum of 4.5 hours (full rate). Additional hours are charged per hour, charged at the full rate for commercial hirings and at weekends (Sat-Sun) plus a weekend surcharge in the amount of a percentage to be determined, which may/will vary per location;
- The lessee shall not rent out the leased space(s) to third parties.
- All costs to be paid to third parties in connection with the letting, including royalties, taxes, social security contributions, fees, etc. shall be borne by the lessee, who is also responsible for paying and declaring them, unless agreed otherwise.
- The prices included in the offer can be adjusted depending on (special) inflationary fluctuations by means of a partial/full price increase.
Art. 3 Technical provisions
- The rental rates include the following technical provisions:
- Trekkenwand, but with limited change (only applicable to the RABOzaal, LIMBURGzaal, Grote Zaal in Kerkrade and the Grote Zaal in Sittard).
- Basic lighting (this varies per location and will be detailed in the relevant quotation).
- Basic sound set (this varies per location and will be detailed in the relevant quotation).
- All technical facilities may only be operated by certified personnel of Parkstad Limburg Theatres.
- Not included in the rental rates are:
- the minimum compulsory purchase of 2 technicians from Parkstad Limburg Theatres, whereby the personnel hours will be charged at the then current hourly rates (in accordance with Art. 12 paragraph 5) and;
the use of further technical resources, whereby Parkstad Limburg Theatres reserves the right to make choices concerning the use of technical resources on the basis of quality and safety, among other factors.
- The lessee will receive more information during the intake interview regarding the rental.
Art. 4 Services
- The following applies to the provision of services
- for socio-cultural hirings, the catering staff (only for use at distribution buffets) is available/included, provided a break is included in the performance/activity/hire. If at least one break is not provided, all additional wage costs of the service staff (except bar staff) will be charged to the hirer;
- in case of commercial hire, the catering staff (only for use at distribution buffets) is provided/included and all additional wage costs of the service staff (except bar staff) will be passed on to the lessee;
- cloakroom staff (use of cloakroom is mandatory) is available/included if a cloakroom fee is charged;
- access control and placarding of guests in the auditorium is available/included and is exclusively reserved for Parkstad Limburg Theatres employees;
- box office and ticketing is available/included and carried out exclusively by PLT at the then current ticket prices and exclusively by Parkstad Limburg Theatres staff;
- FAFS staff are available/included;
- at the Heerlen Theatre, a front door is present/included and the rear door is only present/included if there is multiple seating, unless agreed otherwise;
- at the Kerkrade Theatre (only) in the event of use of the MF auditorium (during HUB opening hours), a front door is available/inclusive and the rear door is only available/inclusive in the event of auditorium seating;
- at the Toon Hermans Theatre Sittard (only) in case of performances/rehearsals with an audience. a front door is available/included and the back door is available/included in case of performances/rehearsals with and without an audience - as a rule being the operation artist foyer;
- standard cleaning is available/included - location-specific deviations are explicitly allowed/available.
- The rental rates exclude the following services, among others:
- catering staff which are deployed for serving drinks/food, with the exception of those cases where the deployment of these catering staff is included in a package price;
Security/EHBO staff, who can be hired on request (see article 13, paragraph 4); - Toilet ladies, these can be hired on request;
extra cleaning; - all additional staff, not being the categories mentioned under Article 4, subclause 2 under a through d.
- catering staff which are deployed for serving drinks/food, with the exception of those cases where the deployment of these catering staff is included in a package price;
- Based on visitor forecasts, Parkstad Limburg Theatres will plan the deployment of personnel and make an offer to the lessee. If the actual situation is so different from the forecasts, Parkstad Limburg Theatres reserves the right to adjust the schedule and quotation. One month before the start of the activity, the lessee is obliged to report the number of tickets sold or donated by the lessee (including all advance sales addresses) to third parties at that time (see Article 9, paragraph 1). The same must be repeated one week (5 working days) before the activity. This allows Parkstad Limburg Theatres to keep a clean record in its booking system on the basis of which Parkstad Limburg Theatres determines its staffing levels. If the difference between the number of visitors stated and the actual number of visitors during the performance/activity/rental is > 50 or more, Parkstad Limburg Theatres reserves the right to pass on the extra personnel costs incurred on a one-to-one basis.
Art. 5 Spaces
- Parkstad Limburg Theatres has three venues, namely: Theatre Heerlen, Theatre Kerkrade and the Toon Hermans Theatre Sittard-Geleen. The following definitions are used for these venues in terms of letting:
- Theatre Heerlen:
- Main Hall (maximum 1100 seats divided over 4 grades - including STER grade)
- Main Hall, 1st floor - including balconies
- Stage area
- Dressing rooms (adjacent)
- Large foyer and associated toilet groups (not in case of rehearsals without audience)
- Artist foyer
- LIMBURG Hall (maximum 390 seats distributed over 4 grades - including STER grade - 700 step seats in case of box seating - 1500 step seats in case of standing concert)
- Flat-floor auditorium (standard seating arrangement), ground floor.
- Dressing rooms (adjoining)

Art. 6 Option scheme
- A rental request for one of our accommodations remains optional until the moment the new season is determined (mid-March each year).
- Because of the real possibility that the situation may arise that an option must be rescheduled (in connection with the dynamics of the professional programming), we recommend indicating a second option.
- The programmers 'guarantee' that one of these two options is/remains available. No rights can nevertheless be derived from an option.
- Immediately after determination of the theatre season (mid-March each year), rental options are converted into final reservations by means of contracts.
- The conditions stated in the contracts are binding. The General Hiring Conditions of Parkstad Limburg Theatres N.V., the House Regulations of Parkstad Limburg Theatres N.V., the Uniform Conditions for the Hotel and Catering Industry and the General Conditions for Visitors of the Association of Theatres and Concert Halls (VSCD) form an integral part of the contracts.
- None of the conditions mentioned in the contracts are subject to negotiation.
- The contract must be signed and returned within the response period stated in the contract (four weeks after the date of the contract), after which the final booking can be converted into a definite booking (with due observance of and in accordance with the rules on the option scheme referred to in Article 6.3). If a signed contract is not received in time, Parkstad Limburg Theatres reserves the right to cancel the performance/activity/rental, whereby it declares Article 7 to be applicable and may/will charge the hirer cancellation costs.
Art. 7 Cancellation of a rental activity/ final booking
- The following rules apply to the cancellation of a letting/activity/final booking by the hirer:
- When cancelling more than six months before the time when the activity would take place, 10% of the rental rate will be charged;
- If cancelled more than three months before the activity, 10% of the total reservation value (the value of the total offer at the time of cancellation) will be charged;
- If cancelled up to more than two months before the activity, 15% of the total reservation value will be charged;
- If cancelled up to more than one month before the activity, 35% of the total reservation value will be charged; General Terms and Conditions of Renting Parkstad Limburg Theatres N.V. Version: February 2026 5
- If cancelled up to more than fourteen days before the activity, 60% of the total reservation value will be charged; f
- If cancelled up to more than seven days before the activity, 85% of the total reservation value will be charged;
- When cancelling from seven days and less before the activity, 100% of the total reservation value will be charged.
- In case of cancellation of a letting/activity/final booking by the lessor, the following rules apply:
- If a booking is registered as an option, Parkstad Limburg Theatres may cancel or move a performance/activity/rental at any time;
- If a booking is registered as final, Parkstad Limburg Theatres can cancel a performance/activity/rental if there are sufficient indications that the nature of the performance/activity/rent is so different from what may be expected on the basis of the information provided. This is solely at the discretion of the Parkstad Limburg Theatres management team in consultation with the technical and facilities department, whereby they declare Article 7 to be applicable by analogy and may/will charge the hirer cancellation costs;
- If the tenant and/or those directly or indirectly involved do not comply with the General Terms and Conditions of Renting Parkstad Limburg Theatres N.V., the Parkstad Limburg Theatres House Rules, the Uniform Catering Conditions and the General Occupancy Conditions of the Dutch Association of Theatres and Concert Halls (VSCD) (which also includes disturbing the peace and quiet), Parkstad Limburg Theatres may cancel the performance/activity/rental and/or withhold or discontinue (operational) services at any time, declaring Article 7 to be applicable mutatis mutandis and charging cancellation costs to the lessee.
- Parkstad Limburg Theatres will only make use of its right of cancellation in the event of extreme necessity, and will at all times try to impose further requirements regarding the course of the performance/activity/rental, the behaviour of the hirer/directly or indirectly involved and/or the occurrence of a case as referred to in Article 7, paragraph 2, sub c, in order to prevent irreversible cancellation;
- If the lessee fails to provide information in good time (at least six weeks before the performance) relating to (additional) performances/activities/data on space, time and staffing, other than that already specified in the rental agreement, Parkstad Limburg Theatres reserves the right to adjust the offer or not to honour the changes - the lessee is entirely responsible for providing correct and timely information;
- Cases of force majeure on the part of Parkstad Limburg Theatres which cannot be remedied within a reasonable period include the following:
- Fire, water damage and flooding as a result of which the theatre space is wholly or largely unusable;
- Requisition of the building by a government body;
- Failure of crucial (theatre) technical systems, including hoisting and dimming systems, (truck) lifts, etc., which cannot be rectified within a reasonable period, with a maximum of thirty minutes;
- Failure of electricity and/or gas or telecommunication connections necessary for the facilitation of the activity;
- Government-related measures linked to epidemic/pandemic situations than any form of epidemic/pandemic situation which forces Parkstad Limburg Theatres to suspend/cancel the option/final booking/rental/activity;
- If the safety of the public and/or staff cannot be guaranteed or cannot be maintained, at the discretion of the Parkstad Limburg Theatres management team;
- Exceptional inflationary increases, incidental or otherwise, which may or may not also result in exceptional increases in out-of-pocket expenses or labour costs.
Art. 8 Publicity
- The aim is to mention all performances/activities/rentals for which Parkstad Limburg Theatres does the ticketing on the website and in the brochure on special pages reserved for this purpose. To this end, the lessee must provide the most basic information before 15 March each year for the following season. If Parkstad Limburg Theatres does not receive this information in time, it will make a description and place it on the site/in the brochure or decide not to place it.
- Additional publicity via Parkstad Limburg Theatres is usually possible for performances/activities/rentals. The tenant will receive more information during the intake interview about the letting and passing on of costs.
Art. 9 Ticket sales
- The lessee is obliged to purchase the ticketing from Parkstad Limburg Theatres, as only Parkstad Limburg Theatres is entitled and has the resources for generating performance tickets, possibly in cooperation with other ticketing systems.
- The auditoriums of Parkstad Limburg Theatres accommodate a limited number of wheelchairs (reserved seats). If the hirer wishes to make use of these reserved seats, the hirer/visitor must make this known when booking by telephone. It is essential that the hirer indicates the dimensions of the wheelchair when doing so.
Art. 10 Invoicing and payment
- The hirer will receive an invoice from Parkstad Limburg Theaters no later than 30 days after a performance/activity/rental. The amount owing must be paid by transfer to the account of Parkstad Limburg Theatres no later than 14 days after the date of the invoice.
- Parkstad Limburg Theatres has the right to send an advance invoice prior to the performance/activity/rental, which must be paid no later than four weeks before the activity takes place. No later than 30 days after the end of the activity, the lessee will receive a final invoice.
- Parkstad Limburg Theatres reserves the right, in the absence of a payment as referred to in Article 10, paragraph 2, to cancel the performance/activity/rental, whereby it declares Article 7 to be applicable by analogy and may/will charge the lessee cancellation costs.
- If and insofar as timely payment is not made, the customer shall be in default without any notice of default being required. Only if a customer is a natural person (consumer), Parkstad Limburg Theatres will send a one-off notice of default with a period of at least 14 days for payment.
Art. 11 Additional terms and conditions
- Pursuant to Article 4, paragraph 1, subparagraph f, the standard cleaning of the rented and described rooms is included in the rental rate (location-specific deviations are expressly permitted/available). The tenant must expressly leave these rooms as he/she found them. If there is anything to be said in advance about the cleanliness of the rooms, this must be reported immediately to the responsible duty manager of Parkstad Limburg Theatres.
- All materials brought along by the lessee, as well as superfluous/bleached items, must be removed from the premises of Parkstad Limburg Theatres immediately after the end of the (last) performance/activity/rental. The lessee may not leave behind or collect any set items and/or materials at a later date.
- Parkstad Limburg Theatres reserves the right to remove any items left behind and to recover any costs from the lessee.
- Used materials of Parkstad Limburg Theatres must be returned neatly and without defects to the relevant person in charge of Parkstad Limburg Theatres.
- The use of confetti, paper shreds, decorations and the like is not permitted. If their use is essential for the performance/activity/rental, permission must be requested from Parkstad Limburg Theatres, which reserves the right to make choices on the basis of, among other things, the safety of buildings, audiences and/or staff, with due observance of the provisions of Article 13. Additional cleaning costs associated with the use of confetti, paper shreds, decorations, etc. will be charged to the lessee on a one-for-one basis. - Posters, flyers and similar advertising material may only be placed in Parkstad Limburg Theatres in consultation and on the instructions of those in charge. Under no circumstances may anything be nailed or stuck in Parkstad Limburg Theatres. Damage resulting from this will be recovered from the lessee/directly or indirectly involved, in accordance with the provisions of Article 13.
- It is not permitted during performances/activities/rents to photograph, make images and/or sound recordings without prior permission from the Parkstad Limburg Theatres management team and in consultation with the companies/artists/tenants/directly or indirectly involved. This also applies to taking photographs with mobile phones/wireless equipment. Parkstad Limburg Theatres will act against violations by addressing the persons concerned, denying them access to the performance and having the recordings destroyed by the person(s) concerned in the presence of an employee of Parkstad Limburg Theatres.
- Parkstad Limburg Theatres reserves the right to make images and/or sound recordings of a performance/activity/hire. The hirer/directly or indirectly involved and visitor will not object to the use of his/her portrait/likeness in the context of the publication of said recordings for publicity for Parkstad Limburg Theatres (in accordance with the relevant privacy legislation).
- The starting times of the performances are as follows:
- Performances in Theater Kerkrade, the Grote Zaal in Theater Heerlen and the Grote Zaal SittardGeleen usually start at 20:00 on weekdays and at 19:00 on Sundays;
- Family performances usually start at 7.30pm;
- Children's performances usually start at 14:30;
- Performances in the Small Hall and on location usually start at 8:30pm on weekdays and 7:30pm on Sundays;
- Performances in the LIMBURG Hall and Laagland Hall in Sittard-Geleen usually start at 20:30 on weekdays and at 19:30 on Sundays;
- Sunday morning performances usually start at 11am;
- The Head of Service has overall coordination/responsibility and is the point of contact for possible problems and questions. He/she is responsible for opening the venue. The hall will usually open to the public half an hour before the start of the performance.
- Performances normally start punctually; once the performance has started, the right to the reserved seats expires. In consultation with the HvD and companies/makers/tenants/directly or indirectly involved, there are possible situations of after-show seating after the start of performances and at different times. This varies based on the nature of the performances. Latecomers are not entitled to refunds.
- To avoid technical glitches, please switch off your mobile phone/wireless devices completely.
- You are not allowed to bring food and/or other refreshments into the building. Refreshments bought in Parkstad Limburg Theatres may not be taken into the auditorium. Consumption is limited to before the start, during the interval or after the performance in the foyer(s), in the DSM Theatercafe or the foyer at Theater Kerkrade.
- The performers' foyer is intended exclusively for those directly involved in the performance/activity/hire. Bringing (alcoholic) refreshments from outside the theatre is not allowed. In principle, the bar is manned every performance/activity/hire day by an employee of Parkstad Limburg Theatres 1 hour prior to the performance. If the lessee wishes to have the bar staffed at an earlier time, this can be done against payment and prior notice (at least six weeks) to the D&E department of Parkstad Limburg Theatres. Drinks are available at a reduced rate.
- Parkstad Limburg Theatres has a general smoking ban throughout the building. Outside the building, smoking is only permitted in designated areas. Renting the theatre or part of it shifts the obligation to comply with this rule to the lessee. In that case, the lessee is also obliged to enforce this ban on its audience/directly or indirectly involved.
- The use of the cloakroom in Parkstad Limburg Theatres is mandatory for safety reasons. Umbrellas, loose coats, bags, helmets and dangerous objects are not permitted in the building/theatres. Parkstad Limburg Theatres reserves the right to carry out an access and/or bag check at any time, or possibly a frisk if the situation so requires, by the authorised (hired) staff/security personnel. 8 The tenant/directly or indirectly involved and/or visitors are obliged to cooperate with reasonable requests within the framework of the legal obligations applicable to Parkstad Limburg Theatres concerning, among other things, security, identification and the limitation of nuisance.
- If a lessee wishes to allow his or her invitees to use the cloakroom freely, a buy-out fee will be charged (location-specific deviations are expressly permitted/available).
- Parkstad Limburg Theatres accepts no liability for loss and/or theft of personal property in general, items left behind in, among others, garments and bags and personal property for which no valid cloakroom ticket has been issued.
- Issue of items as mentioned in Article 11, paragraph 18, will be made exclusively by issuing the cloakroom ticket (location-specific deviations are expressly permitted/available).
- Parkstad Limburg Theatres is at all times entitled to deny tenants, directly and/or indirectly involved, visitors (further) access to the building if cases arise as referred to in Articles 7 paragraph 2 sub c, Article 11 paragraph 7 and Article 11 paragraph 16.
Art. 12 Additional terms and conditions technical service Parkstad Limburg Theatres
- Agreements on the use of the orchestra pit (seat blocking) must be made at a very early stage, explicitly before ticket sales start.
- Agreements regarding the use of other materials such as the ballet floor, grand piano or piano, additional sound or lighting must be discussed and recorded in writing no later than six weeks before the performance/activity/rental.
- The performance leader is in general charge of the work on and around the stage. He/she directs the technical crew of Parkstad Limburg Theatres and, in consultation with the company/tenant/directly or indirectly involved, assigns the work and, in collaboration with the Head of Service, is the point of contact for the company/tenant/directly or indirectly involved during their stay in Parkstad Limburg Theatres. In addition, the performance leader is in contact with the Head of Service and is the one who commissions the performance/activity/rental.
- All materials used must meet the requirements of fire safety and the terms of the Working Conditions Act, among other things. The performance leader has the authority, to reject materials before use. Hirers/directly or indirectly involved must comply with the alternatives offered to allow the performance/activity/hire to go ahead.
- Working hours and staffing are arranged as follows:
- Parkstad Limburg Theatres works in accordance with the VSCD Master Contract, the addendum to the VSCD Master Contract and the addendum to this on the part of PLT. This means that every performance/activity/rental has a standard complement of at least two technicians, i.e. one performance leader/stage manager who also operates the flywall and one all-round technician. If the lessee/direct or indirect party involved does not pass on information about further technical assistance required in good time, Parkstad Limburg Theatres will keep to this minimum standard staffing.
- The technician's lunch break is from 12:00 - 13:00, the dinner break is from 17:00 - 19:00. In the planning made in consultation with the technicians of tenant/direct or indrect involved, we assume that this break can be enjoyed by everyone. If (incidentally) work must continue during the lunch/dinner break, the performance leader will consult with the tenant/direct or indrect involved about the number of technicians required. These technicians are entitled to a lunch/dinner allowance at the then current rate or a dinner allowance at the then current rate - excluding VAT (to be paid by the lessee/directly or indirectly involved), provided the reason for the work being delayed is not Parkstad Limburg Theatres.
- In deviation from Article 12, paragraph 5, sub b, Parkstad Limburg Theatres reserves the right to decide (in joint consultation with the hirer/persons/directly or indirectly involved) to continue the work the next day or to set a different time, taking into account the regulations of the Working Hours Act/CAO Nederlandse Podia.
- If the dismantling of the performance continues beyond 02.00 hours, a short break will be inserted at 01.00 hours. In this case, Parkstad Limburg Theatres will provide sandwiches and soft drinks for all technicians. Hirer/direct or indirect party pays for the sandwiches (and receives an invoice for this at purchase price), Parkstad Limburg Theatres provides coffee and tea free of charge. - Regarding safety on and around the stage:
- Parkstad Limburg Theatres is bound by, among other things, the rules of the Working Conditions Act, the Working Conditions Decree, the Working Conditions Regulations, the Health & Safety Catalogues, the Risk Inventory & Evaluation, all forms of statutory regulations, the operating licence and regulations issued by the fire brigade or other authorised bodies;
- All equipment and installations are operated exclusively by employees of Parkstad Limburg Theatres;
- Prior to, during and after the performance/activity/rental, only the lessee/direct performers are permitted to be on and around the stage, dressing rooms and artists' foyer;
- If pyrotechnical materials/fire effects etc. are used, the hirer/direct or indrect involved must give at least eight weeks' notice. Pyrotechnical materials/fire effects etc. are only permitted and may only be handled by persons with a valid Dutch possession number and with a fire permit issued by the province and an application permit issued by the fire brigade. Parkstad Limburg Theatres reserves the right to refuse to use pyrotechnical materials/fire effects, even if a permit has been issued by a competent authority, if Parkstad Limburg Theatres considers the use of pyrotechnical materials/fire effects unsafe for its employees/audience/building(s);
- Tenants/directly or indirectly involved as well as visitors, technicians, actors and others must comply with and follow the instructions of the authorised employees of Parkstad Limburg Theatres;
- Parkstad Limburg Theatres only uses certified hoisting materials (which are also periodically checked by the competent authorities) and impregnated curtains. We expect the same from our visiting tenant/directly or indirectly involved;
- The use of alcohol and other mind-altering substances is not permitted for technicians who have to perform work on stage;
- The props/decors of the lessee/directly or indirectly involved must comply with, among other things, the rules concerning working conditions legislation and fire regulations, and must be safe. Decors and props may under no circumstances obstruct free passage to the escape routes and must be dismantled and loaded immediately after the performance/activity/rental. Flight cases/decors and suchlike must comply with occupational health and safety legislation (they must be able to be carried or lifted in compliance with the applicable rules), i.e. generally have sufficient handles and be carried by one person up to a maximum of 23 kg. Above 23 kg, the objects to be lifted must be transportable by a sufficient number of suitable people/resources;
- Parkstad Limburg Theatres is responsible for:
- Knowledge of regulations on working safely, as evidenced by a risk inventory and evaluation and the application of this knowledge in practice;
- Providing safety instructions to its own technicians;
- Providing adequate PPE (personal protective equipment) to its own technicians;
- Ensuring safety on and around the stage in general;
- Ensuring the safety (as evidenced by certificates, among other things), maintenance and operation of the theatre's technical installations, tools and materials;
- Ensuring the safety of materials hired by the theatre and used in the production;
- Taking responsibility for the conduct of one's own technicians;
- Scheduling the in-house technicians on the basis of agreements between Parkstad Limburg Theatres and lessee/directly or indrectly involved, in accordance with the Working Hours Act, the Working Hours Decree and in accordance with the Collective Labour Agreement for Dutch Podia. This schedule is drawn up six weeks in advance and communicated to the employees of Parkstad Limburg Theatres.
- Tenant/directly or indirectly involved is responsible for:
- Knowledge of safe working regulations, as evidenced by a production risk inventory and evaluation and the application of knowledge in practice;

- Providing the theatre with correct and complete information on all safety aspects relating to the production;
- Ensuring the safety of own technicians and theatre staff when handling the materials brought along;
- Providing adequate PPE (personal protective equipment) to own technicians and theatre technicians as required when handling the materials brought along;
- Providing appropriate safety instructions to theatre staff during set-up, rehearsal, performance and take-down;
- Ensuring the safety (as shown by certificates), maintenance and operation of the systems, tools and materials brought along;
- Ensuring the safety (as shown by certificates) of materials hired by the lessee/directly or indirectly involved and used in the production;
- Taking responsibility for the behaviour of own technicians;
- Scheduling its own technicians on the basis of agreements between Parkstad Limburg Theatres and the lessee/direct or indrect party concerned, in accordance with the Working Hours Act, the Working Hours Decree and CAO Nederlandse Podia;
- Regarding parking:
- Tenant/directly or indirectly involved at Theater Heerlen in 't Loon can
- At Theater Kerkrade, lessees/directly or indirectly involved can park at the nearby parking facilities with the corresponding rates.
- At the Toon Hermans Theater Sittard-Geleen tenants/directly or indirectly involved can park at the nearby parking facilities with the corresponding rates.
- Parkstad Limburg Theatres uses the services of Q-Park/Fontys regarding the parking facilities, whereby Q-Park may change the parking rates at any time without Parkstad Limburg Theatres' intervention, and Parkstad Limburg Theatres must immediately apply these changed (then current) parking rates.
- Tenants/directly or indirectly involved have the opportunity to load and unload decor and materials at the truck lifts at the rear of all three theatres.
- Further, a general parking ban applies around all three theatres.
Art. 13 Damage and liability
- The lessee/directly or indirectly involved is liable at all times and without reservation for damage caused to the inventory, building, materials, as well as personal and/or material injury to employees/visitors/directly or indirectly involved, caused by himself and his employees/directly or indirectly involved, as well as by participants in the performance/activity/rental organised by him. The hirer therefore acknowledges the obligation to reimburse the costs caused.
- The hirer is at all times obliged to have (company) liability insurance against at least the risk mentioned in article 13 paragraph 1. The insurance policy must be submitted for inspection six weeks prior to the performance/activity/hire.
- The stay of the hirer, those directly and/or indirectly involved and visitors, among others, is entirely at his/her own risk.
- Parkstad Limburg Theatres may require the deployment of event security and/or first aid. This is at the sole discretion of the Parkstad Limburg Theatres management team and at the expense of the hirer/directly or indirectly involved. The choice with regard to a specialised security company and/or first aid is at the sole discretion of Parkstad Limburg Theatres.
- The Working Conditions Act requires companies to have a risk inventory and evaluation (known as RI&E). Parkstad Limburg Theatres has such an RI&E for its own organisation. In principle, any change in working conditions (such as a tenant/directly or indrectly involved person visiting a theatre) obliges those involved to adapt the RI&E. In the theatre sector, this adjustment has taken the form of a production risk inventory (called PRI&E for short). It is a legal obligation - this obligation lies entirely with the companies/makers/amateurs (whether or not mediated/represented by impresarios, booking agencies and the like) - to draw up a PRI&E for each production (and have it tested). Parkstad Limburg Theatres N.V. Version: February 2026 11 Parkstad Limburg Theatres expects its companies/makers/amateurs (whether or not represented by impresarios, booking agencies and others) to fulfil their best efforts obligation to draw up and provide a PRI&E on their own initiative. We therefore ask you to provide Parkstad Limburg Theatres with the PRI&E, together with the technical list, no later than six weeks prior to the visit. If and insofar as Parkstad Limburg Theatres has not received (unsolicited and/or on request) any technical data regarding, among other things, the safety of the production/PRI&E, it assumes that there are no risks involved in the production. The companies/creators/amateurs (whether or not mediated/represented by agents, booking agencies, etc.) are entirely responsible for any extra (precautionary) measures/extra materials with regard to safety, before, during and after the planned production.
- Parkstad Limburg Theatres reserves the right to cancel a performance/activity/rental (whereby it declares Article 7 to be applicable by analogy and may/will charge the lessee cancellation costs)/adjust if the safety of the premises, audience and/or staff cannot be guaranteed, all this depending on the nature and risks of the performance and at the sole discretion of Parkstad Limburg Theatres.
- A PRI&E format to be completed can be provided by Parkstad Limburg Theatres on request and can also be downloaded from the website.
Art. 14 Applicable law and disputes
- Only Dutch law applies to the (rental) agreements/hospitality transactions.
- In the event of disputes between the tenant and/or direct or indirect party concerned and the lessor, the competent court of Limburg shall have exclusive jurisdiction, unless another court has jurisdiction pursuant to a mandatory statutory provision.
- The General Terms and Conditions for Letting Parkstad Limburg Theatres N.V. have been drawn up in accordance with the provisions of Section 6.5.3. of the Civil Code regarding the statutory regulation of General Terms and Conditions. If one or more stipulations in these General Terms and Conditions of Hire of Parkstad Limburg Theatres N.V. prove to be invalid for any reason, the parties are deemed to have agreed a valid replacement stipulation which approaches the invalid stipulation as closely as possible in meaning and scope. The invalidity of one or more stipulations in these General Terms and Conditions for Hire of Parkstad Limburg Theatres N.V. does not affect the validity of all other stipulations.
